TERMS OF SERVICE

This Terms of Service (“ToS”) is made here to stipulate the service conditions of Dopiverse on a smart phone and tablet, which has been developed by Doping Bilisim Teknolojileri Anonim Sirketi. (“Dopiverse”), between individuals using this service (“users” or “user”) and Dopiverse.

“Dopiverse,” or “we,” “our,” or “us” in these Terms of Service means Doping Bilisim Teknolojileri Anonim Sirketi. In all cases, “Dopiverse,” “we,” “our,” or “us” includes agents, consultants, employees, officers, and directors.

Dopiverse operates under the legislation of Turkey (reg number: 170022-5), with its registered office at Cifte Havuzlar Mah. Londra Asfalti Cad. Kulucka Mrk. B2 Blok No: 205 Yildiz Teknik Universitesi Teknopark Esenler, Istanbul, Turkey and subject to VAT under the number 3101275788.

 

Please read these Terms of Service and our Privacy Policy before using Dopiverse’s Services. These Terms of Service set out the terms and conditions that apply when you use our Services (described below). When you use our Services, you agree to be bound by these terms and conditions. If you don’t agree to all the terms and conditions, you or your child must not use our Services.

Our Privacy Policy describes how we collect, store, use, and disclose, and otherwise process your personal information when providing our Services to you, and your rights and choices concerning your information. When you use our Services, you acknowledge that our Privacy Policy applies. If you do not want Dopiverse to collect, store, use, or share your information in the ways described in our Privacy Policy, you must not use our Services.

If the User is minor (under 13), he/she shall become acquainted of these Terms of Use with the help of his parents/legal guardians. We obtain parental consent where required by applicable law before collecting, using, disclosing and processing personal data from children through the use of Dopiverse. Please note that you can contact us anytime for more information about privacy of your child related to useage of Dopiverse.

Dopiverse recommends parents or legal guardians to monitor their children's online activities.

1. Terms and Definitions

“Account” means an account you create when you access the Services.

“Offers” means special programs, including offers, excursions, and special gifts, both digital and tactile, that Dopiverse may offer from time to time to users.

“Service” means Dopiverse, products, services, content, www.dopiverse.com, and/or other domains or websites operated by Doping.

“Terms of Service” or “Terms” means these terms of service.

“User Content” means all the data that you upload, transmit, create, or generate on or through the Services. This includes things like your profile information, avatar, your in-app text, feedback, information when you contact us and your in-app movements or other content authored or designed by you.

“Virtual Content” means (a) virtual currency, including without limitation virtual in-app equipment, ranks, rewards, avatar, all for use in the Services and (b) virtual in-app items.

2. Using the Services

Subject to these Terms, we grant you a non-exclusive, non-sublicensable, personal, non-transferable, revocable, limited license to access and use the Services for your own non-commercial entertainment purposes. You agree not to use the Services for any other purpose.

For freemium usage, you are allowed to use our Services at no cost but restrictedly. To supplement your experience in Dopiverse we offer you subscription.

3. Account Creation

We may ask you to choose a username in order to use our Services.

If you access our Service through a third-party platform like Apple or Google and you are obligated to comply with their terms of service in addition to our ToS.

Dopiverse is directed to children, and we will handle personal data collected from children under the age of 13 (each a “Child” together “Children”) as described in our Privacy Policy. We obtain parental consent where required by applicable law before collecting, using, disclosing and processing personal data from children before the use of Dopiverse. By provide us parental consent in accordance with COPPA before creation of your child’s account, you acknowledge that we will process your child’s data in accordance with our Privacy Policy.

You are solely responsible for protecting your user account and for your account activities. In order to protect our Services, users and Dopiverse itself, we reserve the right, if necessary, to delete any user account if it would breach these ToS or other applicable rules.

4. Trial, Subscription, Payment, and Termination

Trial. If you purchase our monthly subscription Service, you have a trial term as specified. You have right to cancel subscription during the trial term anytime.

Subscription. If you do not cancel your subscription during trial, your Account will be billed continuously for the subscription until you terminate it through your store (App Store, Google Play Store etc.). After your initial subscription period, your subscription will automatically renew monthly on the day after your previous subscription ends, and you authorize us to charge you for the subscription term, unless you terminate your subscription prior to its renewal date through your store.

Payment. You agree to pay all fees and applicable taxes incurred by you or anyone using Account created by you. Dopiverse may revise the pricing for the goods and services, or subscription model offered through Service at any time. Also, Dopiverse may terminate trial application at any time except you are in trial.

Please note that we do not provide price protection or refunds for existing subscribers in the event of a price drop or promotional offering for new subscribers.

You must either use a credit card, debit card or other payment mechanism accepted by us (e.g., Google Play Store, Apple’s iTunes App Store) (“Payment System”) to activate and maintain an Account with subscription. If we do not receive payment from the Payment System you use, you agree to pay all amounts due hereunder upon our demand and will be solely responsible for any dispute with your payment provider. If Payment System provided initially be declined for insufficient funds or any other reason, we reserve the right to attempt to recharge Payment System in full or in lesser installments of the initially incurred charge. You will not be charged more than the amount for which you purchased your Account with subscription. You will be solely responsible for all overdraft fees and/or penalties that may be assessed by your payment provider. We use a third-party service provider to process payments on our behalf. You acknowledge and agree that in the event the third-party payment processor experiences a data breach that affects your information through no fault of Dopiverse, Dopiverse will in no way be responsible or liable to you for any such breach.

Non-refundable. If you sign up for subscription, during trial term no purchase is made. After 3 days of trial, you are not entitled to any refund. If your Account includes any additional add on services, you are not entitled to any refund. If you made any payment for subscription during 3 days of trial term somehow, you are entitled to a refund.

Terminate. After you terminate your subscription, we will not charge you any subscription fees after the expiration of your then-current subscription. Please note we do not provide full or partial refunds for prepaid sums. In any event, you will be able to continue to use Services throughout the remainder of the subscription period for which you have already paid.

5. Ownership

All rights, title and interest in and to the Service (including without limitation any titles, computer code, themes, objects, avatar, avatar names, stories, dialogue, catch phrases, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, copyrights, documentation, avatar profile information, recordings) are owned by Dopiverse. Dopiverse reserves all rights, including without limitation, all intellectual property rights, or other proprietary rights, in connection with Dopiverse and the Service.

So long as you abide by these ToS you may use the Services subject to these Terms, for your own non-commercial, entertainment purposes. You agree not to use the Services for any other purpose and agree that Dopiverse will have no liability to you for any damage or loss arising from unauthorized uses.

If you breach these ToS, or any of our other terms that apply to you, we may take action against you, up to and including terminating your account. In addition, you may be breaking the law, including breaches or violations of Dopiverse’s intellectual property rights. ANY ATTEMPT BY YOU TO DISRUPT OR INTERFERE WITH THE SERVICES, INCLUDING WITHOUT LIMITATION UNDERMINING OR MANIPULATING THE LEGITIMATE OPERATION OF ANY SERVICES OF DOPIVERSE, IS A BREACH OF DOPIVERSE POLICY AND MAY BE A BREACH OR VIOLATION OF CRIMINAL AND CIVIL LAWS.

6. Use Limitation

Any use of the Service in violation of these Use Limitations is strictly prohibited, can result in the immediate revocation of your limited right and may subject you to liability for violations of law.

You agree that you will not, under any circumstances:

Engage in any act that Dopiverse deems to conflict with the spirit or intent of the Service or make improper use of Dopiverse's support services.

Use or take part (directly or indirectly) in the use of cheats, exploits, automation software, emulators, bots, hacks, mods, or any unauthorized third-party software designed to modify or interfere with the Service and Dopiverse.

Modify or cause to be modified any files that are a part of Dopiverse without Doping's express written consent.

Disrupt, interfere with or otherwise adversely affect the normal flow of the Service or otherwise act in a manner that may negatively affect other users' experience when using the Service or playing Dopiverse. This includes win trading and any other kind of manipulation of rankings, taking advantage of errors in the Service to gain an unfair edge over other users and any other act that intentionally abuses or goes against the design of the Service.

Disrupt, overburden, or aid or assist in the disruption or overburdening of any computer or server used to offer or support the Service.

Institute, assist, or become involved in any type of attack, including without limitation distribution of a virus, denial of service attacks upon the Service, or other attempts to disrupt the Service or any other person's use or enjoyment of the Service.

Attempt to gain unauthorized access to the Service, Accounts registered or used by others or to the computers, servers, or networks connected to the Service by any means other than the user interface provided by Dopiverse, including but not limited to, by circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person to circumvent or modify, any security, technology, device, or software that is part of the Service.

Post, share, send any information that is abusive, threatening, obscene, defamatory, libelous, or racially, sexually, religiously, or otherwise objectionable or offensive or engage in ongoing toxic behavior, such as by repeatedly sending information on an unsolicited basis.

Post, share, send any information that contains nudity, excessive violence, or offensive subject matter or that contains a link to such content.

Attempt to, or harass, abuse, or harm, or advocate or incite harassment, abuse, or harm of another person, group, including Dopiverse employees, including Dopiverse customer service representatives.

Make available through the Service any material or information that infringes any copyright, trademark, patent, trade secret, right of privacy, right of publicity, or other right of any person or entity or impersonates any other person, including without limitation a Dopiverse employee.

Reverse engineer, decompile, disassemble, decipher, or otherwise attempt to derive the source code for any underlying software or other intellectual property used to provide the Service, or to obtain any information from the Service or any using, any method not expressly permitted by Dopiverse.

Solicit or attempt to personal information from other users of the Service.

Collect or post anyone's private information, including personally identifiable information (whether in text, image or video form), identification documents, or financial information through the Service.

Use Dopiverse for gambling, betting or any similar activity in which prizes or rewards can be won (directly or indirectly), including betting on the outcome of matches in which you participate as a user, irrespective of whether there is a fee or stake involved.

Dopiverse reserves the right to determine what conduct it considers to be in violation of the rules of use or otherwise outside the intent or spirit of these Terms of Service or the Service itself. Dopiverse reserves the right to act as a result, which may include terminating your Account and prohibiting you from using the Service in whole or in part.

7. Virtual Content

Dopiverse owns, has licensed, or otherwise has rights to use all the content that appears in the Service. Notwithstanding any provision to the contrary herein, you agree that you have no right or title in or to any content that appears in the Service, including without limitation the virtual items, content, features, goods, services, or currency appearing or originating in the Service

8. User Content

The Services may allow you to, including, but not limited to, create a username, contact us through feedback or messages (“User Content”).

You agree that have the right to share and use such User Content, that it and you will not share anything against to ethics, public morality.

You agree that the availability or publishing of any such User Content as part of our Services will not cause us to infringe the rights of any third party or to be in breach of any applicable law or regulation. Please, therefore, make sure you do not post any content which may infringe any third-party rights. We may need to remove any potentially infringing content without notice. You agree to compensate us for any losses we suffer as a direct result of any breach by you of any of the promises made by you in this paragraph.

9. Deleting your Account

You may stop using our Services at any time and may request at support@dopiverse.com that we delete your information at any time. Unless applicable law requires otherwise, we are not required to provide refunds, benefits, or other compensation if you request deletion of your Account.

Termination of your subscription does not mean to delete your Account. Therefore, after such termination, you can continue to have Virtual Content that you have created or acquired until the termination.

10. Warranty Disclaimer

Dopiverse makes no promises or guarantees that the Services or any content on them will always be available, uninterrupted, or error-free. We may suspend, withdraw, or restrict the availability of all or any part of our Services for business and operational reasons.

Use of the services is at your sole risk. they are provided on an “as is” basis. to the extent permitted by applicable law, Dopiverse makes no warranties, conditions, or other terms of any kind, either express or implied, about the services. Dopiverse, disclaims any warranties of title or implied warranties, conditions, or other terms of non-infringement, merchantability, quiet enjoyment, or fitness for a particular purpose.

12. Waiver of Liability

a. You can find personal data we collect, store, use, and disclose, and otherwise process in our Privacy Policy. We are not liable for any loss or damage in the event that you disclose your any personal information further than we collect, store, use, and disclose. For instance, username in Dopiverse does not have to be your real name. If you disclose your name as a username, however, other users may see your name in the App.

b. We have no obligation to monitor the Services for inappropriate or illegal User Content or the conduct of other users, and we take no responsibility for such conduct. We also are not liable for information, materials, products, or services provided by other users (for instance, in their profiles) and User Content is not approved by us. By using our Services, you understand that you may be exposed to conduct that you might find offensive or otherwise objectionable. We do not endorse any User Content posted on the Services, and nor do we guarantee its truthfulness or accuracy. However, if someone is violating these Terms or misusing the Services, please let us know by using the “Report Abuse” link provided in the Services or contacting us at support@dopiverse.com.

13. Class Action Waiver

To the maximum extent permitted by applicable law, you and Dopiverse agree to only bring disputes in an individual capacity and shall not:

seek to bring, join, or participate in any class or representative action, collective or class-wide arbitration, or any other action where another individual or entity acts in a representative capacity (e.g., private attorney general actions); or

consolidate or combine individual proceedings or permit an arbitrator to do so without the express consent of all parties to this ToS and all other actions or arbitrations.

14. Changes to These Terms

We may change, modify, add, or remove portions of the Terms at any time by posting the amended Terms on our sites or within the Services (such as through in-App notices). Unless we state otherwise, changes are effective when posted. New versions of the Terms or other Policies will be accessible at www.dopiverse.com or from within the Services. If you continue to use the Services after the changes are posted, you are agreeing that the changes apply to your continued use of the Services.

 

15. Force Majeure

We are not liable for any changes or problems out of our control, including but not limited to, changes or problems caused by natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

16. Severability

If any term or provision is determined by a court of competent jurisdiction to be invalid or unenforceable, the remainder of this ToS shall not be affected, and each term and provision of this ToS shall be valid and enforceable to the fullest extent permitted by law.

17. Applicable Law

This ToS is governed by and construed in accordance with the laws of Turkey. All disputed arising out of or in connection with this ToS shall be resolved by means of correspondence and negotiations without recourse to a court. In the case that User and Dopiverse fail to come to an agreement without recourse to a court within 60 (sixty) business days from the date of the receipt of the relevant claim, or disputes shall be resolved by Turkish Law.
